2917/2012: PROCEDURAL LAW ON CONTEMPT OF COURT : IMPOSITION

Hon. Ajith P. Perera,— To ask the Minister of Justice,—

(a) Is he aware that —

(i) there is no procedural law on contempt of court in effect in Sri Lanka;

(ii) it has been recommended by the United Nations Human Rights Committee in the “Tony Fernando” case that a procedural law on contempt of court should be imposed in Sri Lanka; and

(iii) a draft of the procedural law on contempt of court has been passed by the Bar Association of Sri Lanka and submitted to the Ministry of Justice ?

(b) Will he state—

(i) whether he admits that a procedural law in relation to contempt of court should be imposed in Sri Lanka soon; and

(ii) if so, the date on which the relevant Bill will be moved in Parliament ?

ගරු කථානායකතුමනි, එම ප්‍රශ්නයට පිළිතුර මෙසේය.

(අ) (i) ශ්‍රී ලංකාව තුළ දැනට අධිකරණයට අපහාස කිරීම පිළිබඳ කාර්ය පටිපාටික නීතියක් පවතී. සිවිල් නඩු විධාන සංග්‍රහයේ 65 (LXV) පරිච්ඡේදයේ අධිකරණයට අපහාස කිරීම පිළිබඳ ලඝු කාර්ය පටිපාටිය පිළිබඳ විධිවිධාන යොදවා ඇත.

(ii) ඔව්.

(iii) ඔව්.

(ආ) (i) ඔව්. දැනට මේ සම්බන්ධයෙන් පවතින සිවිල් නඩුවිධාන සංග්‍රහයේ විධිවිධාන ඇතත්, සෑම අධිකරණයකටම අදාළ කර ගත හැකි වන පරිපූර්ණ නීතියක් සැකසීම වඩාත් සුදුසු යයි හැ‍ඟේ.

(ii) මේ සම්බන්ධයෙන් දැනට ශ්‍රී ලංකා නීතිඥ සංගමය සහ ශ්‍රී ලංකා නීති කොමිෂන් සභාව විසින් කෙටුම්පත් දෙකක් සකස් කර අධිකරණ අමාත්‍යාංශයේ අවධානය පිණිස යොමු කර ඇත. එම පනත් දෙක අධ්‍යයනය කිරීමෙන් සහ අදාළ විවිධ ක්ෂේත්‍රයන් සමඟ සාකච්ඡා කිරීමෙන් අනතුරුව කෙටුම්පත් සකස් කර පාර්ලිමේන්තුවට ඉදිරිපත් කිරීමට බලාපොරොත්තු වේ.
