Select Committee of Parliament to look into and report to Parliament on the matter of selecting the Electoral System under which the Provincial Council Elections should be held and submit its proposals and recommendations in that regard,— Whereas all the Provincial Councils are currently functioning without people’s representatives since the delimitation process of wards required for implementing the 'Mixed Proportional Representation System', which was introduced in terms of the provisions of Act No. 17 of 2017 which is in effect at present amending the Provincial Councils Elections Act No. 2 of 1988, has not been completed;
And whereas the Select Committee of Parliament to identify appropriate reforms of the Election Laws and the Electoral System and to recommend necessary amendments, which was appointed in 2022 by the Ninth Parliament, discussed the fact that draft laws are required for enabling the implementation of the ‘Mixed Proportional Representation System’, which was introduced by the Provincial Councils Elections (Amendment) Act No. 17 of 2017, by carrying out the delimitation as required in terms of the said Amendment Act as per the ratio stipulated therein, and recommended that appropriate laws be enacted for holding the Provincial Council Elections under the Proportional Representation System until draft laws referred to above are prepared, but the report of the said Committee, which consisted of 17 Members, had been presented to Parliament on 22 June 2022 with the signatures of only 8 Members;
And whereas the report of the Minister in terms of Standing Order 52(6) of Parliament on the Provincial Councils Elections (Amendment) Bill, which was presented to the Parliament on 05 June 2025 for the first reading, was presented to Parliament on 19.11.2025 by the Minister of Public Administration, Provincial Councils and Local Government; and
Whereas there are different viewpoints on the appropriate electoral system for holding the Provincial Council Elections and the dialogue on the electoral systems of the country has broadened and intensified after 2017, and whereas an extensive dialogue should be created on preparing an electoral system including provisions for mandatory women representation, youth representation, limits on expenditure, mixed proportional representation system, ensure right to advance voting and voting right of the Sri Lankans living abroad etc.;
This Parliament resolves that a Select Committee of Parliament be appointed to look into and report to Parliament on the matter of selecting the Electoral System under which the Provincial Council Elections should be held and submit its proposals and recommendations in that regard.
2. (a) that the Chair and Members of the Committee shall be appointed by the Speaker; and
(b) that in terms of the provisions of Standing Order 101 of Parliament, the Committee shall not consist of more than twelve (12) Members.
3. That the Committee shall have the power to —
(a) fix its quorum;
(b) summon any person to appear before it, to require any person to procure any document or record, to procure and receive all such evidence, written or oral, as the Committee may think it necessary for the fullest consideration of the matters referred to above;
(c) obtain the services of specialists and experts in the relevant fields to assist the Committee; and
(d) make interim reports from time to time and to sit notwithstanding any adjournment or prorogation of Parliament.
4. The Committee shall present its report to Parliament within a period of three (03) months from the first meeting of the Committee or within such further period as Parliament may grant.
